Draft Safety, Health and Welfare at Work (General Application)(Amendment)(No. 3) Regulations 2010 (re: Use of Work Equipment) |

The Health and Safety Authority requests comments and observations on the proposals for the draft Safety, Health and Welfare at Work (General Application)(Amendment No.3) Regulations 2010 (Re: Use of Work Equipment) prior to submission of the proposals to the Minister for Labour Affairs and Public Service Transformation at the Department of Enterprise, Trade and Innovation (Mr Dara Calleary) for his consideration. The proposed revision of Chapter 2 of Part 2 of the General Application Regulations 2007 is designed to transpose Directive 2009/104/EC of the European Parliament and of the Council of 16 September 2009 concerning the minimum safety and health requirements for the use of work equipment by workers at work (codified version), by substituting new provisions for Regulations 27 to 61. Directive 2009/104/EC consolidates, without substantive amendment, the texts of Council Directive 89/655/EEC of 30 November 1989 concerning the minimum safety and health requirements for the use of work equipment by workers at work, as amended by Council Directive 95/63/EC of 5 December 1995. Accordingly, the proposed amended Regulations are "technical" amendments that do not involve any substantive changes to the corresponding duties set out originally in S.I. No. 299 of 2007 as amended by S.I. No. 732 of 2007. In addition to transposing Directive 2009/104/EC, Chapter 2 of Part 2 of the Regulations also retains various other provisions of the 2007 Regulations relating to the use of work equipment. In that respect the only changes incorporated in these proposed Regulations relate to Regulation 55 concerning safe working loads for excavators, loaders or combined excavators and loaders when used for object handling.
